Artist Terms

These terms apply whenever you submit artwork for Trading Art Shop. They keep your copyright with you while giving MaskedWaffle the permission needed to review, build and distribute the game.

Who can submit

You must be at least 18 and able to enter this agreement. Do not submit on behalf of another artist unless you have their written authority to grant every permission in these terms. Each new or replacement artwork is governed by the version you accept when it is submitted.

Your artwork stays yours

You retain copyright and all other rights you already hold in your artwork. You can continue to display, sell and license it elsewhere. These terms grant a non-exclusive licence; they do not transfer ownership to MaskedWaffle.

What you confirm

When you submit artwork, you confirm that:

  • you created it and own or control all rights needed for the uses in these terms;
  • no generative AI was used at any stage to create, generate, edit or assist with any part of it;
  • it does not copy or closely imitate another creator's work, infringe intellectual property, misuse a person's image or private information, or break the law;
  • you have any permission needed for identifiable people, third-party material, characters, brands or other protected content it contains; and
  • the information and profile material you provide is accurate and does not impersonate or mislead people.

Tell us promptly if any confirmation stops being accurate. We may reject or remove material that is unlawful, deceptive, hateful, sexually explicit, unsafe, unsuitable for the game, or likely to create a rights or platform-policy problem.

The game licence

You grant MaskedWaffle a worldwide, royalty-free, non-exclusive licence to store, review, reproduce, adapt, display, communicate and distribute the submitted artwork and your artist profile material as part of Trading Art Shop and its builds, updates, patches, ports, backups and player-facing services. The licence includes the right to sell and otherwise distribute the game commercially and continues until it ends under the removal section below.

We may allow developers, publishers, contractors, distributors, storefronts and platform operators to use the material only as needed to make, test, distribute, operate and support Trading Art Shop. The licence does not allow us to sell your artwork by itself, use it for unrelated merchandise or NFTs, or use it to train a generative AI model without a separate written agreement with you.

We may transfer this licence only with Trading Art Shop or the part of the business that operates it. Any successor remains bound by these terms, including the limits on use and removal process.

Card treatment and credit

We may resize, crop, compress, convert or colour-process the artwork and combine it with card frames, text, effects and game interfaces. We will not intentionally make changes that are derogatory or damaging to your reputation. To the extent permitted by law, you consent to these agreed treatments and will not object to them solely because they change the artwork's format or presentation.

We will use reasonable efforts to connect an accepted card with the artist name supplied in your profile where the format supports it. Your artist name, logo, country and selected social handles may be shown to players. Credit can be corrected in a future update, but cannot be guaranteed in every screenshot, clip, platform listing or technical context.

Promotion is a separate choice

The game licence is required to submit. Promotion is optional. If you select the promotional-use box, you also permit MaskedWaffle to use that artwork, its card and your artist attribution in trailers, store pages, press material, events and social posts promoting Trading Art Shop.

You may withdraw promotional permission by emailing privacy@maskedwaffle.com, or by deleting your artist account. We will not feature your work in new promotional material after withdrawal. Existing screenshots, videos, posts, press material, printed material, store assets and third-party copies may remain where they have already been published or distributed. Withdrawal from promotion does not withdraw the game licence.

Review and selection

Submission does not guarantee acceptance, inclusion in a release, placement, promotion, player attention, commissions or other paid work. We may accept, decline, suspend or remove artwork for quality, rights, legal, safety, platform or project-fit reasons. Material edits or a replacement file may return a card to review. A declined card returns its submission slot and is removed from any Evolution until resubmitted and accepted.

Payment and Patreon tiers

Free and paid Patreon tiers provide the submission formats and allowances shown for the relevant cycle. They do not purchase your copyright and are not a commission. Unless we separately agree in writing, no royalty, revenue share or other payment is due for use permitted by these terms.

Removing artwork

You can delete a live submission or your artist account in the portal, or email us with a removal request. Account deletion removes the live profile and submissions from the website and queues released cards, artist details and artist icons for removal from the next game update. If the artwork has not entered a released or committed game build, deletion ends the game licence once we have completed reasonable technical and record-keeping steps.

If the artwork is already in a released build, or a build already supplied to a developer, distributor or platform for release, we will stop including it in later releases and updates within a reasonable operational period. Existing builds and copies already supplied or distributed do not have to be recalled: players and platforms may continue to download, re-download, run and support them. The licence continues only as needed for those existing builds and for reasonable backups, release records and legal claims.

Rights concerns and responsibility

If a third party raises a credible rights concern, we may temporarily hide, suspend or remove the material while it is reviewed. We will normally contact you and consider information from both sides before making a final decision, unless urgent action is reasonably needed.

You are responsible for reasonable direct losses and costs caused by your material breach of the confirmations above, but not to the extent a loss was caused by MaskedWaffle's own conduct. We will give you reasonable notice of a claim and will not agree a settlement that admits fault on your behalf without consulting you. Nothing here limits rights or responsibility that cannot lawfully be limited.

Law, changes and contact

These terms are governed by the law of England and Wales. If you are a consumer, you keep mandatory protections available under the law where you live. If one term cannot be enforced, the remaining terms continue to apply.
